TERMS AND CONDITIONS OF SALE


These Terms & Conditions (“T&Cs”) apply to all orders placed through Toto’s Books online store by consumers (private individuals).


Contract Formation


  • Product listings on the website are non-binding and subject to availability.  By placing an order (“Submit Order”), you make a binding offer to purchase.

  • We confirm receipt of your order by email (“Order Confirmation”) — this does not yet mean acceptance.

  • A contract is concluded only when we send you a Shipping Confirmation (or when we ship the goods).


Prices & Payment


  • All prices are in Euros (EUR) and include VAT.


  • Shipping costs are shown separately at checkout and also include VAT.


  • Accepted payment methods: Direct IBAN transfers to DE49 1001 8000 0551 0324 02 and PayPal coming soon.



Shipping & Delivery


  • Delivery is made to the address you specify at checkout/shop2shop.


  • Standard delivery times (non-express):


    • Within Germany: approximately 1–2 business days


    • European Union: approximately 2–8 business days, depending on destination



Right of Withdrawal / Returns Policy


-  Right of Withdrawal


  • Under EU consumer law, you have a statutory 14-day “cooling-off” period to withdraw from this contract without giving any reason. 


  • The withdrawal period begins the day after you (or a third party indicated by you) takes physical possession of the goods. 


  • To exercise this right, you must inform us (Toto’s Books UG) clearly, e.g., by email, about your decision to withdraw.


-  Effects of Withdrawal


  • If you withdraw, we will refund all payments received from you, including standard delivery costs, without undue delay and within 14 days after we receive your withdrawal notice. 


  • Refunds will be made using the same payment method as the original transaction, unless we explicitly agree otherwise.


  • We may withhold the refund until we receive the goods back or you provide proof of return shipment, whichever happens first.


  • You must return the goods within 14 days of notifying us of withdrawal. 


  • The return shipping cost is borne by you (the customer), unless stated otherwise at the point of purchase. 


  • You may be liable for the diminished value of the goods if neglect or handling beyond what is necessary to ascertain their nature, characteristics, and functionality causes it. 


 - Exclusions to Withdrawal


The right of withdrawal does not apply, in particular, to:

  • Goods made to your specifications or clearly personalized. 


  • Sealed audio, video or software products once opened by the consumer. 


Warranty (Defects)


  • We comply with the statutory warranty for defective goods under German law. 


  • If a product is defective, you may demand repair (“replacement”) or a price reduction.


  • The statute of limitations for warranty claims is two years from the date of delivery. 


Liability


  • We are liable without limitation for intent and gross negligence.


  • For ordinary negligence, our liability is limited to foreseeable damages typical for contracts of this type.


  • We are not liable for indirect or consequential damages unless caused by intent or gross negligence.


Data Protection


We collect and process your personal data (name, address, email) ONLY to fulfil orders.


Final Provisions


  • If any provision of these T&Cs is or becomes invalid, the rest remains in effect.


  • We reserve the right to change these T&Cs. Changes apply only to future orders, not to orders already placed.


  • These Terms & Conditions constitute the entire agreement between you and Toto’s Books UG with respect to the subject matter.
